HI-VIS HEROES- TERMS AND CONDITIONS OF SALE AND RETURN POLICY
1. DEFINITIONS
1.1 Welcome to the Hi-Vis Heroes website. Please read our terms and conditions of business carefully, these terms govern your use of our Website. By using this site and/or placing an order, you are agreeing to the terms we have itemised below.
1.2 These terms and conditions apply to all contracts entered between Hi-Vis Heroes and its customers.
2. TRADEMARK AND COPYRIGHT
2.1 This site is owned and operated by Hi-Vis Heroes. The material contained on this Website, including all design, text, graphics, selection and arrangement of content and all other information on this site are copyright to Hi-Vis Heroes or its licensees, content providers or technology providers.
2.2 All rights reserved. Permission is granted to copy, print and distribute in hard copy sections of this site for the purpose of browsing and shopping or for placing an order at www.gorillaworkwear.co.uk
2.3 Any unauthorised use of the material (especially forwarding prices to our competitors) on this site without the prior permission of www.gorillaworkwear.co.uk is a violation of copyright, trademark and other applicable laws and immediate litigation will follow.
2.4 Hi-Vis Heroes respects all relevant trademarks, which are marked accordingly.
3. QUOTES AND ORDERING
3.1 Discount codes cannot be applied to existing deals such as bundles or promotional offers.
3.2 Discount code usage is applied at the sole discretion of Hi-Vis Heroes.
3.3 Please note that colour samples shown may not exactly match the colours on the actual garments. Please contact us if you have any enquiries.
3.4 Products specified as no VAT may have additional terms which qualify customers for no VAT, an example is safety footwear, individual purchases not for employees (subject to safety rating) will qualify for no VAT however purchases for employees will require the addition of VAT. 3.5 Hi-Vis Heroes withhold the right to refuse orders, at their sole discretion, for (but not limited to):
(a) Offensive graphics and icons
(b) Offensive words and slogans
(a) Copyrighted material
(b) Copyrighted images or phrases
4. PRICE AND PAYMENT
4.1 The price payable for the goods you order is as set out on our website at the time you place your order or, plus any charges for carriage as set out in the order form. We reserve the right to change the price of goods, due to market conditions but we will confirm the prevailing price with you before accepting your order. We are not obliged to accept your order for such goods and may decline it or limit the order quantity.
4.2 Occasionally an error may occur with our system and goods may be incorrectly under-priced, in which circumstances we will not be obliged to supply the goods at the incorrect price.
4.3 If you are an account customer, payment shall be made in full within 30 days of invoice. Time shall be of the essence for payment. We may revoke credit if you fail to make payment when due. If the payment has not been made by the last day of month following delivery then interest shall accrue thereon at the rate of 8% per annum from the date of invoice until receipt by us of the full amount (including any accrued interest) whether before or after judgment, together with any reasonable legal or other recovery costs.
4.4 Subject to clause 4.3, we must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage and insurance, before your order can be accepted unless we have agreed otherwise in advance in writing.
4.5 Title or ownership in the goods supplied by Hi-Vis Heroes to the customer shall not pass to the customer until such time as full payment has been made, full payment being the receipt of cleared funds in respect of the whole order relating to the goods supplied.
4.6 In the event of the customer needing to change the design, artwork or another aspect of the order, the customer must give the request to Hi-Vis Heroes in writing. Hi-Vis Heroes seek to make the changes in accordance with this request but must reserve the right to charge the customer the additional cost of any such changes arising out of this request and will notify the customer of the costs such as changes at the time of the request. Hi-Vis Heroes also reserve the right to amend the initial delivery time frame should any changes to an order be required. Orders requiring new artwork will not be started until artwork is signed by customer.
5. DELIVERY
5.1 Every effort will be made to deliver goods on time, but no responsibility can be accepted for late or non-delivery.
Any time or date stated for delivery is given and intended as an estimate only and Hi-Vis Heroes shall not be liable for any loss or damage whatsoever resulting from any delay in delivery howsoever arising.
5.2 Hi-Vis Heroes shall be entitled to make partial deliveries or deliveries by instalments and all the provisions of these terms shall apply to such deliveries.
5.3 Signature of the company's delivery note by any employee, representative or agent of the purchaser shall be conclusive proof of delivery.
5.4 Upon delivery of the goods to you, the goods shall be at your risk. All goods should be checked upon delivery, and we require any discrepancies to be reported within 24 hours.
6. RETURNS, CANCELLATIONS & REFUNDS
6.1 Hi-Vis Heroes points out that whether it accepts a return of goods is entirely at its own discretion except where the return of goods is as a result of the failure on the part of Hi-Vis Heroes to supply the relevant goods in accordance with the order.
6.2 Goods cannot be returned if individual design or embroidery work has been undertaken on such goods and/or the customer has used the goods and/or itself added the design or embroidery work.
6.3 If you are returning goods for any other reason than they are faulty, items must be returned within 14 days of delivery for a refund. The items must be received by us in unopened and in a saleable condition. There will be a restocking fee of 20% or £10, whichever is greater, and delivery and return delivery charges will not be refunded.

7.1 The information on this website is intended as information only and should never be used as a substitute for legal or professional advice.
